Large Investor-Loss Federal Sentencing: Organizing Complex Financial and Personal Records

In a multi-million-dollar case, more documents do not automatically produce a clearer record. The preparation challenge is to show what each source establishes and what remains disputed.

Establish a reliable document structure

Separate transactions, investor records, valuations, recoveries and personal-history materials. Assign stable references and keep a change log for working summaries. A reviewer should be able to trace a statement to its source without searching an entire discovery collection. Missing material should have an owner and follow-up date, not disappear into a general to-do list.

Separate enterprise totals from individual facts

A company-wide figure does not itself describe one person’s role or benefit. Record appointment dates, actual responsibilities, authority changes and supported compensation information. Counsel determines relevant conduct and legal attribution. The preparation record should neither assume that every employee shared the same role nor minimize established responsibility through unsupported comparisons.

Document harm and corrective work carefully

Investor impact and the individual’s circumstances need accurate treatment. Avoid describing a financial recovery as complete when it depends on future liquidation. For corrective work, identify the action, date, verification and continuing limits. A control written on paper is different from a control that has operated and been independently checked.

Give counsel a reviewable handoff

An effective package includes an executive factual summary, source index, open-question list and separate personal-history chronology. Keep calculations supplied by experts attributed to them. SAG works on the agreed supporting record; counsel evaluates Guidelines disputes and sentencing arguments. Neither a large dollar figure nor a strong personal record supports a guaranteed outcome.

Sources and the next preparation question

USSC: 2026 Guidelines Manual. Source checked November 5, 2026. Counsel evaluates the governing law and individual facts.

Does a multi-million-dollar allegation establish the sentence?

No. The legal framework, established facts and individualized sentencing considerations must be evaluated. A headline amount is not a sentencing calculation.

A defined preparation assignment

Agreed deliverables can include a personal-history chronology, an indexed supporting file, factual questions and a practical preparation schedule. Investigation-stage legal decisions require qualified federal defense counsel. An engagement with SAG does not automatically establish privilege.
