SEC Asset Freezes and Receiverships: A Practical Records Guide
An account balance does not establish that funds are available to spend. During an asset freeze or receivership, the controlling orders and authorized instructions matter.

Inventory the actual restrictions
Collect the relevant orders and written notices through counsel. List affected accounts, entities, assets and named custodians. Record the source of each restriction rather than relying on a bank representative’s informal summary. Whether an expense or transaction is permitted requires review of the governing documents, not an assumption based on past account access.
Separate ownership, value and availability
An ownership interest, estimated market value and accessible cash are three different facts. Record liens, joint interests, restrictions and valuation dates where supported. Do not move, retitle, conceal or dissipate assets to change the picture presented to a court or agency. Questions about permitted payments belong with counsel.
Maintain a receiver communication log
Where a receiver has been appointed, preserve notices, claims instructions and authorized communications. Note deadlines and unresolved questions without treating a possible distribution as completed restitution. Avoid reconciling accounts by deleting discrepancies. A difference between the receiver’s statement and a personal record should remain visible for professional review.
Plan for household and business continuity
Document actual recurring expenses, dependents, insurance and responsibilities affected by the restrictions. Counsel can evaluate any legal relief or payment request. SAG can help assemble the factual inventory and practical family plan. The deliverable is an accurate, dated record, not advice on obtaining access to frozen money or predicting a recovery.
Sources and the next preparation question
SEC: How Investigations Work. Source checked November 5, 2026. Counsel evaluates the governing law and individual facts.
Can SAG obtain release of frozen assets?
No. Requests concerning court orders and restricted property require legal representation. SAG can organize supporting factual records within an agreed assignment.
A defined preparation assignment
Work directly with Joseph to establish the scope, source records, authorized recipients and review dates. Agreed deliverables can include a personal-history chronology, an indexed supporting file, factual questions and a practical preparation schedule. Investigation-stage legal decisions require qualified federal defense counsel. An engagement with SAG does not automatically establish privilege.
SAG serves clients nationally from Freehold, New Jersey, with travel arranged for cases. Share your stage and next deadline in the initial inquiry. Do not upload investigative records, investor details or privileged advice.
