False Tax Return Cases Under 26 U.S.C. § 7206

A return’s signature, preparation history and supporting documents answer different questions. Keep those records precise while counsel evaluates the charged subsection and legal issues.

Identify the subsection and document

Section 7206 contains several provisions. Its first two address declarations under penalties of perjury and aid or assistance involving fraudulent or false material matters. Counsel must identify the precise subsection charged and explain how the law applies.

Do not use the phrase false return as a complete description of the case. Record the specific return, statement or other document identified in the charge, its period, version and associated count. A factual index should not make unsupported legal conclusions about intent or materiality.

Reconstruct the preparation workflow from sources

Identify who gathered information, maintained books, prepared the draft, reviewed it, signed it and transmitted it. Use engagement letters, dated correspondence, source documents and available filing records. Separate a person’s formal title from the work they actually performed.

A later recollection should be labeled as such. Do not revise original workpapers to make them match a new narrative. Counsel can direct preservation and explain how a separately dated clarification should be handled.

Keep return versions and source changes visible

Preserve original and amended returns with their supporting records. A version table can show the date, preparer, relevant changes and source for each description. Do not assume that every revision has the same purpose or legal effect.

Where several clients or entities are involved, create separate entries. Avoid applying one client’s facts to another because the same preparer worked on both. The individual’s role and knowledge must be addressed through the actual evidence and counsel’s analysis.

Prepare the financial questions for the right professionals

A false-return charge and a sentencing tax-loss calculation are different analytical tasks. Identify supporting tax periods, calculation versions and unresolved factual questions for counsel and qualified financial professionals. SAG does not provide an accounting opinion or determine the applicable offense level.

Payments, outstanding civil balances and potential restitution should have their own supporting schedules. Keep completed transactions distinct from future plans, and retain confirmation of how payments were received and allocated.

Develop a personal record that can be verified

For presentence preparation, organize employment, education, family responsibilities, treatment and documented corrective work. A professional’s training and responsibilities should be described accurately without overstating credentials or minimizing the relevant conduct.

Joseph can create a chronology, personal-history inventory, character-support guidance and an indexed handoff for counsel. Any public statement, licensing response or submission to the government belongs within the responsible professional’s advice and review.

Sources and related preparation

Official United States Code: 26 U.S.C. § 7206. Source checked November 5, 2026. Counsel must evaluate the rules and facts applicable to your case.

Are the signer and preparer necessarily facing the same allegation?

No. Counsel must assess each person’s role, the subsection and the evidence. Preparation should document individual responsibilities rather than assume they are identical.
