Separate intent from completed payment
A planned payment, initiated transfer and confirmed receipt are different stages. Record each with dates and supporting documents. Retain returned-payment notices and reversals. A personal spreadsheet should not describe a transaction as completed merely because you requested it. Counsel should review any proposed action involving restricted funds or an ongoing investigation.
Match payments to the correct obligation
Identify the loan, entity and recipient associated with each transaction. A business may have several loans or accounts, and a payment may be applied differently from what the sender expected. Keep correspondence about allocation with the payment record. Do not use a single total that conceals which obligation actually received credit.
Preserve servicing statements and discrepancies
Retain statements before and after the payment and note any unresolved difference. Do not alter a statement to match your ledger. Keep a question list with the date and source of the discrepancy. SBA OIG has published oversight work concerning returned EIDL funds; that broader report does not establish what happened to an individual borrower’s transaction.
Keep legal conclusions separate
Repayment history can be relevant to preparation, but its effect on a loss calculation, restitution or another proceeding requires legal review. SAG can help organize the evidence and chronology. It cannot promise that paying funds prevents charges, determines a sentence or ends every obligation. Use a realistic household plan based on confirmed resources.
Continue your preparation
Can repayment guarantee that charges will not be filed?
No. Counsel evaluates the circumstances. Document payments accurately without treating them as a guarantee about charging or sentencing.
Sources and a defined preparation assignment
Official context: SBA OIG: returned EIDL funds (2024 oversight report). Sources checked November 6, 2026. Program resources and historical oversight reports do not decide an individual case. Counsel evaluates the applicable law, dates and facts.
Work directly with Joseph to define the scope, authorized recipients and review dates. Agreed deliverables can include a personal and professional chronology, indexed supporting records, factual questions for counsel and a practical preparation schedule. SAG does not manage legal responses or provide forensic accounting. An engagement does not automatically establish privilege.
SAG serves clients nationwide from New Jersey, with travel arranged for cases. SAG is not a law firm. No charging decision, sentence, placement or release date is guaranteed.
