Start with the actual calculation
Identify who prepared the proposed loss figure, the document containing it and its date. Record the loans, entities and periods included. A news report or total loan balance is not a substitute for the calculation under review. Keep alleged, agreed, disputed and judicially determined amounts clearly labeled, with each supporting version preserved.
Build a loan-by-loan ledger
For each loan, record requested, approved and disbursed amounts separately. Add documented returns, repayments and other recoveries without assuming that every item is legally deductible. Keep payment dates and recipients traceable. Counsel determines the applicable loss rules and treatment of each item; the working ledger should provide facts rather than a self-selected legal result.
Identify duplication and scope questions
Check whether several schedules repeat the same loan, transfer or recovery. Flag a possible duplicate with its references rather than silently deleting it. Identify whether a figure describes one individual, one entity or a broader alleged scheme. Responsibility and relevant-conduct questions require legal analysis, even when the source data are organized clearly.
Keep loss and restitution workstreams connected
A sentencing loss question and a restitution obligation should not be treated as interchangeable merely because both use dollar figures. Maintain the underlying records and a separate question list for each. Joseph’s published restitution analysis, linked in the publication column, explains why a reviewable financial record matters; it does not predict a reduction in your case.
Continue your preparation
Should I subtract every repayment from the alleged loss?
Do not do so automatically. Record the payment and its supporting documents; counsel evaluates its legal treatment and timing.
Sources and a defined preparation assignment
Official context: U.S. Sentencing Commission: 2026 Guidelines Manual. Sources checked November 6, 2026. Program resources and historical oversight reports do not decide an individual case. Counsel evaluates the applicable law, dates and facts.
