SDNY Federal Sentencing Strategy and Sentence Reduction Preparation

Facing sentencing in the Southern District of New York? Sentencing Advocacy Group helps federal defendants organize mitigation evidence, prepare for the presentence investigation, and plan for custody and reentry. Work directly with Joseph De Gregorio, a federal sentencing strategist whose own EDNY case informs his practical approach to preparation.

What should you prepare before sentencing in the SDNY?

Start with a documented account of your circumstances, conduct, and rehabilitation that your defense attorney can evaluate. For an executive, financial professional, or business owner, that means explaining more than professional achievements: what happened, who was affected, what responsibilities you accept, and what has demonstrably changed.

SAG helps organize personal history, treatment and education records, employment information, family responsibilities, and firsthand character references. Your attorney determines the legal strategy, resolves disputed facts, and decides what to submit.

The Southern District’s courthouse locations include Manhattan and White Plains. Your preparation should follow your assigned court’s schedule and your attorney’s instructions.

What does the SDNY U.S. Attorney’s enforcement approach mean for your preparation?

The SDNY’s February 2026 corporate self-disclosure announcement emphasized financial-market integrity, individual accountability, remediation, and victim compensation. It also made clear that corporate disclosures can lead to cases against individual executives and employees. A corporate resolution does not establish an individual defendant’s sentencing outcome.

SAG’s preparation approach is to turn general claims of accountability into records counsel can assess. Depending on your circumstances, that may include a timeline of corrective action, verified financial information, treatment participation, or documented changes to business practices. An enforcement announcement describes prosecutorial policy. It does not tell you what your judge will decide.

Will an SDNY defendant be held at MCC New York or MDC Brooklyn?

MCC New York is closed and should not be treated as a current surrender destination. MDC Brooklyn is an operating federal detention facility in the New York area. Confirm any actual detention or surrender location through counsel and official instructions before making arrangements.

Preparation for detention should address access to necessary medical information, family responsibilities, and communication with counsel. A nearby detention center is not a promise about where a person will serve a sentence. The Bureau of Prisons makes designation decisions using security, programming, and other placement considerations.

How does Joseph’s 75% reduction experience in the EDNY apply to an SDNY case?

In his own EDNY case, Joseph faced an advisory guideline range of 41–51 months and received one year and one day, without a cooperation agreement. He describes that outcome as an approximately 75% reduction compared with the upper end of the range. He served 125 days in federal custody before transitioning to home confinement.

That experience informs how he helps clients organize a personal record, prepare accurate information, and think ahead about custody. For an SDNY financial case, the practical application is a preparation plan tailored to the defendant’s role, documented circumstances, and counsel’s priorities.

His EDNY result is not precedent binding an SDNY judge, and it does not establish a likely reduction for another defendant. The sentence imposed and the time spent inside a prison are separate measures; home confinement does not mean the sentence has ended.

How can SAG support your SDNY preparation?

SAG’s sentencing and mitigation preparation, PSR preparation, and prison preparation connect the work before sentencing with practical planning afterward.
