SEC Subpoenas and Document Requests: Organizing the Response Record
A response begins with the actual request and a controlled records process. A large document collection is not the same as a complete, accurate response.

Keep the request and its versions together
Retain the request, attachments, delivery information and any written changes. List each demand using its original numbering. Record dates as stated and distinguish them from extensions or milestones confirmed by counsel. A copied calendar entry should not silently replace the controlling instruction.
Build a custodian and location map
Identify where potentially relevant material is maintained: email, approved messaging systems, shared drives, brokerage records, archived devices and third-party administrators. Note who controls access and whether retention settings may affect availability. This is an inventory for counsel, not an instruction to collect indiscriminately or bypass workplace access restrictions.
Track what has actually happened
Use separate statuses for identified, collected, reviewed and produced. Include the reviewer, production date and reference supplied by counsel when available. If a file is missing, record the gap and the reason known to you. Do not infer that a search was complete because a folder is empty, or certify that documents were produced when they were only uploaded internally.
Keep legal decisions with the response team
Counsel determines scope, objections, privilege, format and communications with staff. The SEC may compel documents and testimony under formal investigative authority; a grand-jury subpoena belongs to a different process. SAG can organize approved background materials and a practical preparation schedule without making responsiveness or privilege decisions. Preserve originals and clearly date later explanatory notes.
Sources and the next preparation question
SEC: How Investigations Work. Source checked November 5, 2026. Counsel evaluates the governing law and individual facts.
Is an SEC subpoena a criminal indictment?
No. It is a demand within an investigative process. Ask counsel to identify the issuing authority, required response and any separate criminal exposure.
A defined preparation assignment
Work directly with Joseph to establish the scope, source records, authorized recipients and review dates. Agreed deliverables can include a personal-history chronology, an indexed supporting file, factual questions and a practical preparation schedule. Investigation-stage legal decisions require qualified federal defense counsel. An engagement with SAG does not automatically establish privilege.
SAG serves clients nationally from Freehold, New Jersey, with travel arranged for cases. Share your stage and next deadline in the initial inquiry. Do not upload investigative records, investor details or privileged advice.
